This website is operated by T. R. Wurster Construction Co. Inc. DBA Solution 7. Throughout the site, the terms “we”, “us”, "seller" and “our” refer to Solution 7.  Solution 7 offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Solution 7 owns this website and its content which is protected by applicable intellectual property rights, including patents, copyrights, trademarks, and other proprietary rights. The copying, redistribution, use or publication by the user of the information contained on this website is strictly prohibited except as expressly permitted by these Terms of Service. The information provided on this website is provided in good faith on an “as is” basis.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

To the fullest extent permitted by law, Buyer shall defend, indemnify and hold harmless Seller and their agents and employees from claims, demands, causes of actions and liabilities of every kind and nature whatsoever arising out of or in connection with buyer's usage of the purchased products, and caused or alleged to be caused, in whole or in part, by any act or omission of Buyer or anyone employed directly or indirectly by Buyer. This indemnification shall extend to claims occurring after this Agreement is terminated as well as while it is in force. The indemnity shall apply regardless of any passively negligent act or omission of Seller, or their agents or employees, but Buyer shall not be obligated to indemnify any party for claims arising from the active negligence, sole negligence, or willful misconduct of Seller or their agents or employees, or arising solely by the designs provided by such parties. To the extent that related laws limit the defense or indemnity obligations of Buyer to Seller, the intent hereunder is to provide the maximum defense and indemnity obligations allowed by Buyer under law. The indemnity set forth in this Section shall not be limited by any other provision of this Agreement.

Seller's liability shall be limited to the purchase price of the materials excluding shipping and taxes, the Seller warrants that materials will be furnished in good condition. For natural stone and wood products there is no guarantee regarding the natural character of stone which varies within each unique item. The seller should research and satisfy that the products being installed are appropriate for the intended application prior to ordering, Solution 7 does not provide specification services.

For items manufactured by the Seller, a 1 year workmanship warranty applies. If a defect becomes apparent within one year, the Buyer shall provide the seller with written notice accompanied by photo and video of the defect. The Seller shall replace or repair (at the Seller's option) the defective material, the Buyer shall pay for all costs of shipping and labor and all other expenses related to the product replacement. In the case that the Seller is re-selling an item that was manufactured by others, the Seller is a distributor and not a manufacturer. Seller therefore assigns and transfers applicable manufacturer's warranties to the customer. In no event will seller be liable for any incidental, punitive, special, or consequential damages arising directly or indirectly from the use of the product. Manufacturers' warranties are limited to product only and do not cover labor. For additional information please contact us for the manufacturer's documentation.
